Information Regarding Day & Zimmermann's Privacy Practices:

This document describes Day & Zimmermann's policy regarding information received about you during visits to our web site (the “Site”). The amount and type of information received depends on how you use our site.

Normal Web Site Usage:

You can visit Day & Zimmermann's web site to read product and company information without telling us who you are and without revealing any personal information. The only information we collect and store during normal web site usage is the name of your Internet service provider, the web site that referred you to us, the pages you request and the date and time of those requests. We use this information to generate statistics and measure site activity to improve the usefulness of customer visits. During normal web site usage we do not collect or store personally identifiable information such as name, mailing address, email address, phone number or social security number.

Collection and use of personally identifiable information:

There are instances where we might request personally identifiable information to provide the web site visitor a service, respond to a request submitted through our website, or send other correspondence (promotions and mailed brochures). This information, such as name, mailing address, email address, type of request and possibly additional information, is collected and stored in a manner appropriate to the nature of the data and is used to fulfill your request. We do not collect any sensitive personal information to meet these requests. If you tell us that the information should not be used as a basis for further contact, we will respect your request. The information you provide is used by Day & Zimmermann to improve the services we provide you. It is never provided to any other company for that company's independent use.

To open and maintain records of our interactions with you and your company, to provide you with the products and services you requested on behalf of your company, and to communicate with you for business purposes.

Job-related information: such as employer, title and job role.

To maintain our business relationship with you or the company for whom you work.

Other delivery information:  name and address of recipient for delivery, if different from yours.

To deliver to the person at the address which you have requested.

Payment information:  name, card issuer and card type, credit or debit card number, expiration date, CVV code, billing address, bank account number and other bank account details.

To accept payment from you, to check that the right person is using the right card or account, to meet the requirements of the card brands or account issuers, and to make sure we are paid for what you buy.

Legal information:  fraud checks or flags raised about your transactions, the payment card you want to use, payment card refusals, suspected crimes, complaints, and claims.

To protect you, other customers and our business against criminal activities and risks, make sure we understand and can meet our legal obligations to you and others and can defend ourselves.

Preference information:  your marketing preferences, your account settings including any default preferences, any preferences you have indicated, the types of services/offers that interest you, or the areas of our web site that you visit.

To enhance your online experience, including as a way to recognize you and welcome you to the Site, to provide you with customized Site content, targeted offers, promotions and advertising on the Site, through other third-party sites, via email, or text messages that are offered by us or other marketing partners that might be of interest to you.

Communications:  communications we have with you.

To handle your requests, to contact you when necessary or requested, including to respond to your comments and questions and provide customer service.

Device information:  IP address, internet provider, operating system and browser used, type of device, such as laptop or smart phone, device cookie settings and other device details, such as MAC address and geolocation, if you permit it to obtain your precise geolocation.

To make sure our Site works properly with your device and make sure you can see and use our intended web site on the device you are using, and for analytical and demographic purposes and to provide offers that may be of interest to you.  

We also will use this information to protect the security or integrity of the Site and our business, such as by protecting against and preventing fraud, unauthorized transactions, and managing risk exposure, including by identifying potential hackers and other unauthorized users.

Information automatically collected from your browser:  when you use the Site, some data is automatically transferred from your browser to our server, including your browser type, operating system type or mobile device model, viewed webpages, links that are clicked, IP address, mobile device identifier or other unique identifier, sites or apps visited before coming to our Site, the amount of time you spend viewing or using the Site, the number of times you return, or other click-stream or site usage data, emails we send that you open, forward, or click through to our Site.

We will use this information in an aggregated non-specific format for analytical and demographic purposes.

We also will use this information to protect the security or integrity of the Site and our business, such as by protecting against and preventing fraud, unauthorized transactions, and managing risk exposure, including by identifying potential hackers and other unauthorized users.

In Connection with Business Transfers

In the event that a division or part or all of Day & Zimmermann is bought, sold, or otherwise transferred, or is in the process of a potential transaction, customer information will likely be shared for evaluation purposes and included among the transferred business assets.

To Comply with Laws

Day & Zimmermann may also disclose specific information when such disclosure appears necessary to comply with the law, a subpoena or other litigation process or to protect the interests or safety of its visitors and customers, Day & Zimmermann employees or others.

No Sale or Sharing of Personal Information

We do not sell your personal information, nor do we share it with third parties for cross-context behavioral advertising.

Consent and Use

The submission of personal or business data (including email addresses, names, and addresses) is done on an explicitly voluntary basis. In submitting such data, you indicate your consent that such data may be collected, stored, processed, or used by and/or disclosed to Day & Zimmermann and its affiliates, agents and third-party service providers for the purpose of making contact with you, responding to your requests for information, or for other purposes indicated by you, as well as for the protection of our own legitimate business interests. Day & Zimmermann may also disclose personal or business data, as may be required by law or a court order, subpoena, or other similar legal instrument. Your consent to our use of your personal data may be withdrawn by you at any time by contacting Day & Zimmermann at privacy@dayzim.com.

Retention of Personal Information

Personal information that we collect, access, or process will be retained only as long as necessary and proportionate to fulfill the purposes for which it was collected or to comply with legal or regulatory requirements, unless otherwise provided in agreements between you and Day & Zimmermann or as required or authorized by law. We strive to retain your personal information no longer than is reasonably necessary to carry out the purposes listed in this Notice or as required by law. Personal information that is no longer required to fulfill the identified purposes will be destroyed, erased, or made de-identified.

Security

We maintain reasonable and appropriate measures designed to maintain information we collect in a secure manner. We have taken certain physical, electronic, and administrative steps to safeguard and secure the information we collect from visitors to the Sites. Even though we follow reasonable procedures to try to protect the information in our possession, no security system is perfect, and we cannot promise, and you should not expect, that your information will be secure in all circumstances. 

Children

Day & Zimmermann operates a business-to-business marketplace.  Only registered users 18 and older and connected with a partner business are permitted to use the Sites.

Under Age 13

The Sites are not directed to children, nor do we knowingly collect any personal information from children under the age of thirteen without verifiable parental consent. If you believe that a child has provided personal information to us, please contact us promptly as described below, and we will endeavor to investigate and delete such information from our systems. 

Under Age 18

Minors under 18 years of age may have the personal information that they provide to us deleted by sending an email to privacy@dayzim.com requesting deletion.  Please note that, while we make reasonable efforts to comply with such requests, deletion of your personal information does not ensure complete and comprehensive removal of that data from all systems.

Third-Party Websites

The Sites may contain links to third-party websites, such as social media sites like LinkedIn, Facebook, and Twitter, which may have privacy policies that differ from our own. We are not responsible for the activities and practices that take place on these websites. Accordingly, we recommend that you review the privacy notice posted on any external site before disclosing any personal information. Please contact those websites directly if you have any questions about their privacy policies. 

Do Not Track

Do Not Track (DNT) is a privacy preference that users can set in some web browsers, allowing users to opt out of tracking by websites and online services. At the present time, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals and therefore, Day & Zimmermann and the Sites do not recognize DNT.

Changes to Privacy Notice

We reserve the right to change our Privacy Notice. A revised Privacy Notice will only apply to data collected subsequent to its effective date. Any revisions will be posted at least 10 days prior to its effective date.

Your California Privacy Rights

California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared with third parties for their own direct marketing purposes, including the categories of information and the names and addresses of those businesses with which we have shared such information.  As discussed elsewhere in this Privacy Notice, we do not currently share the personal information of California residents with third parties for their own direct marketing purposes.  However, if you have further questions about our privacy practices and compliance with California law, please contact us as explained below.
